FMCSA Extends CDL Medical Card Waiver: What Employers Need to Know

safetytxt, August 21, 2025October 3, 2025

On August 21, 2025, the Federal Motor Carrier Safety Administration (FMCSA) announced an important modification to its waiver regarding Commercial Driver’s License (CDL) medical certification.

Previously, CDL holders were permitted to rely on the paper copy of their Medical Examiner’s Certificate (MEC or “medical card”) for 15 days following their DOT exam while the medical provider uploaded results to the National Registry.

Effective immediately, that period has been extended to 60 days.

Why the Change Matters

This modification provides drivers and carriers more flexibility when navigating the gap between medical exams and record updates. However, it doesn’t eliminate the compliance risks tied to medical certification.

Here’s what employers should consider:

  • Driver Compliance Risk– If a medical provider fails to upload MEC results in time, drivers still risk CDL downgrade once the 60-day period ends.
  • Operational Impact– A driver pulled from service due to an expired or unverified MEC creates costly downtime and scheduling disruptions.

Litigation Exposure – Gaps in medical certification are frequently exploited by plaintiff attorneys in the event of crashes, painting carriers as negligent in managing driver qualifications.

Best Practices for Employers

To protect operations, fleets should:

✅ Track MEC Expiration Dates Proactively – Don’t rely solely on the waiver window. Create reminders well before expiration.
✅ Audit Driver Qualification Files (DQFs) – Ensure documentation is complete, current, and accessible in case of audit or litigation.
✅ Leverage Technology & Outsourcing – Compliance solutions like MLB Drivers’ MEC and MVR monitoring services ensure no driver falls through the cracks.
✅ Document Safety & Training Efforts – FMCSA auditors and courts alike expect proof of a strong safety culture. Programs like SafetyTXT’s Focus on Safety, with weekly mobile-based safety training and built-in certification, create a defensible record of compliance and commitment to safety.

Final Thoughts

Now is the time to review your compliance processes and strengthen your safety culture.
